It has been a busy week working on planning issues in Darebin.

Here is some video footage taken trying to save the tree at

There have been interviews on 3AW with Neil Mitchell.

Also, DADA is organizing a meet the candidate forum on planning issues for the future of Darebin on Saturday, September 15th, 12.30 to 2.30pm at the Intercultural Centre, Roseberry Avenue, Preston. Please put the date in your diary. We would love to see you there to listen to and ask questions of candidates about your planning concerns.

And, the City of Darebin is about to embark on developing the Darebin Council Plan for 2013 – 2017. This is a great opportunity for us to influence the future of Darebin and we are being asked for input.
Keep an eye out for the planned community forums. I haven’t seen any dates yet.

It will be a great place to push for a Significant Tree Register but it is also an opportunity to push for much, much more.

25 Madeline Street Preston Plans

Dear all – it is with pleasure that I report that last night Darebin Council rejected unanimously the proposed development of 10 storeys overlooking Bundoora Park. It will now of course go to VCAT but the residents are in a stronger position as they are on the same side as council. 604 objections were received – thanks to all who helped.

Now for the bad news: 25 Madelaine Street, Preston

I received a council letter last night informing me that they had an application to build 6 units at 25 Madeline Street (the gorgeous little California bungalow on the corner). Yes – six on a normal Preston suburban block! The applicant is Ikonomidis Reid Pty Ltd – a name well known to those concerned about appropriate development.

The deadline on my letter for objections is 14 July – even though no signage had gone up as of this morning, (which I have reported to council so anyone living in Madeline street I would appreciate you being able to confirm this if it is disputed).

I am aiming to get the matter before council so I need 100 Objections – I know it is a big ask for a local development rather than a massive tower, but is it also seriously excessive and quite obviously a trojan horse – they are testing the waters, and if they get this without a fight it will set a very ugly precedent.

Please please lodge an objection – obviously, the closer you live the better but anyone in Cazaly ward will be great, and even outside – we need to get it before full council. The mayor made some good comments last night about preserving our streets by keeping over-development out of them and I would like the opportunity to hold him to those comments.

I have just looked on the web – the plans are not yet on there for viewing so I have attached both the plans and an objection form with the details of the developer and proposal.

If I could ask that you drop me a line when you have lodged an objection so I can keep track that would be wonderful.

I hope to have a leaflet for distribution in letterboxes in the immediate area in the next few days, and would appreciate anyone being able to give me a hand – just let me know.

Darebin Council Bribes

Two articles appeared in this weeks newspapers relating to Darebin Council and bribery allegations…

Probe underway at Darebin Council

THE Local Government Investigations and Compliance Inspectorate has confirmed Darebin Council is under investigation.

 The Inspectorate’s senior communications advisor Vicki Bonet sent a statement to the Leader this morning saying: “The Inspectorate has conducted preliminary enquiries into a matter at Darebin Council”.

But it has not disclosed any details of the matter under review.

This revelation follows explosive claims on ABC radio and a metropolitan daily that both the Victorian Ombudsman and the Inspectorate were investigating the council in relation to controversial planning decisions, which were first published in the Leader earlier this year.

The claims revolve around alleged relationships between developers and some councillors.
 Northern Metropolitan Region Greens MP Greg Barber also raised concerns with Planning Minister Matthew Guy in State Parliament yesterday, asking if he was aware of any investigations into Darebin Council or was undertaking any investigation to get to the bottom of claims.

 Mr Guy said he had no ability to investigate the council’s planning decision and urged anyone with concerns to take them to the Inspectorate or the Ombudsman for investigation.

 Mr Barber said Mr Guy’s response to the concerns was evasive and unsatisfactory.

 “The Leader group has known about these problems in planning at Darebin for a long time and now everyone one knows there are investigations,” he said.

 “This puts every planning decision made at Darebin under a cloud and the Minister’s response is not good enough.’’

Ombudsman Victoria would not confirm whether it was investigating the council.

Ombudsman told of Darebin bribes

THE Ombudsman’s office has been told that at least one councillor at an inner Melbourne council has been sounded out with possible bribes to make favourable planning decisions.

Investigators are believed to have interviewed several councillors and staff at Darebin City Council about the allegations and the handling of contentious planning decisions.
The Local Government Investigations and Compliance Inspectorate has also begun investigating. A whistleblower has told The Age that an intermediary had indicated to at least one councillor that they could get at least $5000 from a developer for agreeing to a planning decision.

The whistleblower is believed to have passed the information to the Ombudsman’s office. The Age has seen no evidence that any councillors have in fact been offered bribes.

The Ombudsman’s investigation is believed to be several months old, with some council insiders interviewed several times. Cr Trent McCarthy, of the Greens, said no one had ever approached him, ‘‘ andI don’t think they ever would’’ .

‘‘ I have heard rumours from time to time about these sorts of things, and I hope they would be properly investigated,’’ he said.

One councillor, so concerned about the handling of planning decisions at the council, quit its powerful planning committee last month.

‘‘ It has been a difficult time for this committee during the last few months, where matters appear to have been determined on factors not associated with proper planning principles ,’’ Cr Vince Fontana told the local Leader newspaper.

When contacted by The Age, Cr Fontana stood by the comments and his decision to quit the committee.

‘‘ What was published there covers it I guess,’’ he said.

Mayor Steven Tsitas, who stepped in to take Cr Fontana’s position on the planning committee , said he did not share Cr Fontana’s concerns.

‘‘ I don’t know what he was talking about, quite frankly, all I can conclude is he has taken a position that is more to do with politics than fact,’’ he said. All councils in Victoria, except Brimbank, will go to the polls in October.

Said Cr Tsitas: ‘‘ The council is just getting on with the job, and at the end of the day we are like all families.

‘‘ I suppose there will be some who go in different directions, but at the end of the day they are mindful that they have to come home at some place.’’

The chairwoman of the Darebin planning committee, Diana Asmar, said in a written statement: ‘‘ Since taking over as chair of the planning committee in December 2011, I’ve worked to respond to community feedback by bringing greater transparency to the committee.

‘‘ Cr Fontana did not raise any concerns or issues about the planning committee with me prior to resigning. His resignation wasa surprise, but I respect that it’s his choice to make.’’
The Local Government Investigations and Compliance Inspectorate confirmed it had held ‘‘ preliminary inquiries into a matter’ ’ at Darebin Council.

The Ombudsman’s office would not confirm or deny the investigation.

Save Bundoora Park

Developers have lodged plans for a 10 storey tower with 474 units and 11 shops on the former Smorgy’s site on the corner of Plenty Rd and Snake Gully Drive Bundoora. [map]

If you think that this is an over development and want to object then make sure each adult in your household fills in an objection form. You can get these from Darebin Council Planning Department by calling 8470 8850.

This application is no joke. It is serious. Darebin’s Planning Committee recently approved an 8 storey tower in a 5 storey zone – so we must make our voices heard or they could approve a 10 storey tower in this 3 storey area.

Please act today. We need 100 written objections to be heard by full council.

Some key planning grounds for objection to are:

  • the plan fails to respect the low-rise neighbourhood character of the Bundoora area
  • fails to preserve adequate mature tree coverage on site
  • will impact on the health of mature gums on and near the site
  • fails to provide adequate car parking for 474 units
  • will adversly impact on Snake Gully Reserve & Bundoora Park
  • will overlook childrens’ playgrounds in Bundoora Park
  • will have unacceptable off-site traffic and noise impacts
  • ignores current resident 1 zoning of the site
  • excessive building bulk & overshadowing on park & housing
  • exceeds the 3 storey vision for site in Council’s 2009 study

September 2013 – Site Approved – Smorgy’s Site Planning Approved

Legislation to remove consultation on development applications

Dear Darebin Appropriate Development Association,

I am writing to warn of impending Baillieu Government Planning legislation to remove the right of the public to be consulted about development in their community. I hope you will distribute this information to your local community members.

In March 2012, the Minister for Planning told a development community lunch that Code Assess legislation would be introduced this financial year. The announcement was reported in the Herald Sun and in The Age newspaper.


For communities, Code Assess is frightening. They can come home from work to find their neighbour’s house knocked down to be replaced by a high rise development. As long as the Code Assess standards are met, local residents have no right to be given any notice, they cannot object to Council and they have no rights to appeal to VCAT.

Looking at each block of land without reference to a broader vision is a threat to the fine grain of the neighbourhood generated by our historic built environment. What is at stake here is the very liveability of Melbourne.

A fast track planning process for developers could add additional burdens to already struggling social and community infrastructure like roads, schools, public transport and health services.

I am particularly concerned that the Minister is about to introduce legislation without any consultation in circumstances where the Government controls both houses of parliament. This means there may be limited opportunity to scrutinise and consult on the legislation prior to it being rammed through the Parliament.

I urge you to contact your members and ask them if they want to contribute to the campaign to stop this attack on the rights of Victorians. More information and a campaign petition can be found by visiting http://www.springst.com.au/

As the legislation has already been drafted and could be introduced any day now I ask that this issue is given your urgent attention.
