Tribunal’s planning powers anger councils

Some councils are voicing concern about the Victorian Civil and Administrative Tribunal overturning their planning decisions.

A reminder that DADA is meeting next week at 33 Dean Street, Preston  at 7pm on Wednesday the 14th of August 2013

Councilor Bo Li will attend to discuss Darebin’s new draft Municipal Strategic Statement.

The document is now available for comment on the  Darebin website.

Amendment 138 is especially important for future planning and development for most, but if you live along or near St Georges Road and Plenty Road you should also look at C136 and C137.

The other agenda item for the meeting will be objector updates.  
Please send me your latest news to share if you can’t make the meeting.

We continue to fight inappropriate development in Darebin, over and over again.Note that plans 48 Murphy Grove have again been lodged for 4 units on the site.
We will be mounting a strong objection case, stay tuned.

DADA Meeting: April 17, 2013

Meeting Notes: April 17, 2013

Present: Marian Coffey, Keith Coffey, Maria Poletti, Laara Eames, Sally Mendes

1. Business Arising:

a. Letter from Local Government Minister re Ombudsmen’s report: basically claiming not appropriate for her to intervene though concerns noted

b. Pre-budget submissions: unsuccessful- suggested we apply for Community Grants

Action: keep some of the ideas for the community grants program

c. Ombudsman’s report: still waiting

d. Council’s Strategic Statement: How does this relate to the new Planning Strategy?

e. Metropolitan Planning Strategy: feedback from papers keep an eye on what happens next

f. New State Gov. Residential Zones, must be at council to decide what areas in Darebin will be in what zones

Action: Maria to send Bo a question on Darebin’s process and whether there will be community involvement

2. Objector Updates:

a. 25 Madeline Street, Preston: VCAT hearing date 17th of April, one day, Council rep Michael Detrick made a good submission on behalf of Darebin Council. Mr. McKenzie, represented the developer. Member Mr. Martin.

b. 57 Station Street, Fairfield: application by Cornetta Partners for 15 appts, 3 – story refused by council in Feb and has gone to a VCAT appeal P666/2013

c. 43-47 Simpson Street, Northcote: lost VCAT appeal, Permit was granted in line with and subject to council conditions.

d. Miller Street, Thornbury: Been to VCAT, may be continuing?

e. Foodworks, St Georges Road Preston: going to VCAT next week

f. 42 Gertz Avenue: had a VCAT practice hearing, objectors weren’t notified until after the date

3. Current Planning Applications: the following are those listed for 4 or more dwellings

Action: Craig to check and send on to Maria to send out.

4. Correspondence:

a. Victoria Lindores, Wingrove Street: asked about parking requirement for a house extension planning application

b. Councilor Bo Li, sent a detailed report of Darebin Council decisions

Action: Maria to ask Bo who the new appeals advocate is. Rang council direct, Robert Phillips has been appointed Appeals Advocate.

Action: Maria to ask Bo if a process in place for feedback on the new MSS

c. Mary Drost, Planning Backlash: Supreme Court Case, Orrong group versus VCAT re significance of the number of objectors against a planning application.

5. Other

a. East Preston PS: Craig has been talking to principle at Preston East PS regarding the community garden and use by the community. Bo Li has requested a reply.

Action: Craig to contact Bo Li.

b. Planning Issues and links to health issues: We feel that making links to community health issues, such as heat and greening of the city should be added to objections and seriously considered by council when assessing planning applications.

Action: Everybody send in to Maria any health and planning related ideas that can be included in Council and VCAT submissions

c. Council considering a solar panel and hot water program for low income households

d. Council to consider free tea and coffee for low income residents in specific shops in Darebin

e. Council: Mayor to write to Matthew Guy to intervene on behalf of council on VCAT Smorgies planning application decision

f. Council: Mayor to write to federal minister re sol parent’s reduction in income.

6. Next Meeting:7.00pm Wednesday 15th May at 33 Dean Street, Preston
